Terms of Service — AI Photo Studio

These Terms of Service govern your access to and use of the AI Photo Studio service operated by Yehor Razkevych ("byRazkevych"), including the web application at https://studio.byrazkevych.com and the FramePulse desktop application. By creating an account or using the Service, you agree to these Terms.
1. Description of Service
AI Photo Studio provides automated AI-powered background replacement for photographs. The Service consists of a Web Application for account management, generation dashboard, live feed, and downloads; and FramePulse Desktop Application for local file monitoring, image processing configuration, and real-time generation management (Windows, macOS, and Linux). You provide your own API credentials for the third-party AI generation service.
2. Account Registration
You must create an account through our authentication provider. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate information during registration.
3. Subscription, Payments and Refunds
The Service offers free and paid subscription plans. Paid plans are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refund Policy: If you are not satisfied with the Service, you may request a full refund within 14 days of your initial subscription purchase. Refund requests must be sent to egor.razkevich@gmail.com. Refunds are not available after the 14-day period or for renewal charges. Partial-month refunds are not provided unless required by applicable law.
4. User Content and Intellectual Property
You retain all rights to your photographs. We process images in-memory only — photographs are never permanently stored on our servers. Once processing completes, all image data is immediately discarded. You are responsible for ensuring you have the right to process any photographs you submit.
5. Acceptable Use
You agree not to: generate illegal, harmful, or offensive content; violate laws or third-party rights; reverse-engineer the Service; circumvent rate limits or security measures; use unauthorized automated tools; or share account credentials.
6. Rate Limits
The Service enforces rate limits for fair access. Exceeding limits may result in temporary restrictions.
7. Third-Party Services
The Service integrates with third-party providers for authentication and billing (Clerk), AI image generation (BytePlus Seedream), and managed infrastructure services. Your use of these is subject to their respective terms. We are not responsible for third-party availability or practices.
8. Desktop Application
FramePulse is provided "as is" for Windows, macOS, and Linux. It monitors designated folders and communicates with our servers. All settings and API credentials are stored locally on your device. Auto-updates are delivered through our servers.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service or that AI results will meet your expectations.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.
11. Account Termination
We may suspend or terminate your account for Terms violations. You may delete your account at any time — all server-side data will be permanently removed per our Privacy Policy.
12. Changes to Terms
We may update these Terms. Material changes will be posted here with an updated date. Continued use constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of Poland.
